The accession by the European Union to the European Convention on Human Rights (ECHR) has opened up new possibilities in terms of the constitutional recognition of fundamental rights in the EU. In the field of employment law it heralds a new procedure for workers and trade unions to challenge EU law against the background of the ECHR. In theoretical terms this means that EU law now goes beyond recognition of fundamental rights as mere general principles of EU law, making the ECHR the 'gold standard' for fundamental (social) rights. This publication of the Transnational Trade Union Rights Working Group focuses on the EU and the interplay between the Strasbourg case law and the case law of the Court of Justice of the European Union (CJEU), analysing the relevance of the ECHR for the protection of workers' rights and for the effective enjoyment of civil and political rights in the employment relation. Each chapter is written by a prominent European human rights expert and analyses the case law of the European Court of Human Rights (ECtHR), and also looks at the equivalent international labour standards within the Council of Europe (in particular the (Revised) European Social Charter), the International Labour Organization (ILO) (in particular the fundamental rights conventions) and the UN Covenants (in particular the International Covenant on Economic, Social and Cultural Rights) and the interpretation of these instruments by competent organs. The authors also analyse the ways in which the CJEU has acknowledged the respective ECHR articles as 'general principles' of EU law and asks whether the Lisbon Treaty will also warrant a reassessment of the way it has treated conflicts between these 'general principles' and the so-called 'fundamental freedoms'.

Board Level Employee Representation in Europe analyses the role, activities and networking of board level employee representatives in sixteen European countries and their counterparts operating in companies that have adopted European status. Board level employee representation is viewed as a key element of worker participation in Europe, but there has been only limited international comparative research that establishes what board level employee representatives do and how their activities vary between countries. Based on a large-scale survey distributed to board level employee representatives (circa more than 4,000 respondents), this study identifies the personal characteristics and industrial location of board level employee representatives, what they do and how they interact with other parties within and outside of the company. This study fills in a knowledge gap at a time when policy debates are considering stakeholder models of corporate governance as a means on the way out of the crisis and the achievement of sustainable economies. The book allows direct comparisons between clusters of countries for the first time, as the same survey instrument has been employed in all the participating countries. The research findings demonstrate a large variation in what constitutes board level employee representation in practice, including the relations between board level employee representatives and parties within and external to the company, and the pattern of influence of board level employee representatives on strategic company decision-making. Aimed at practioners, researchers and policymakers alike, this book makes a vital contribution to the field, and will be the definitive work on board-level employee representation for the foreseeable future.

The current crisis in Europe is being labelled, in mainstream media and politics, as a ‘public debt crisis’. The present book draws a markedly different picture. What is happening now is rooted, in a variety of different ways, in the destabilisation of national models of capitalism due to the predominance of neoliberalism since the demise of the post-war ‘golden age’. Ten country analyses provide insights into national ways of coping – or failing to cope – with the ongoing crisis. They reveal the extent to which the respective socio-economic development models are unsustainable, either for the country in question, or for other countries. The bottom-line of the book is twofold. First, there will be no European reform agenda at all unless each country does its own homework. Second, and equally urgent, is a new European reform agenda without which alternative approaches in individual countries will inevitably be suffocated. This message, delivered by the country chapters, is underscored by more general chapters on the prospects of trade union policy in Europe and on current austerity policies and how they interact with the new approaches to economic governance at the EU level. These insights are aimed at providing a better understanding across borders at a time when European rhetoric is being used as a smokescreen for national egoism.

This book is a follow-up to the ETUI 2012 volume 'The triumph of failed ideas'. The focus of the book is the weight attributed to the different economic and social development paths in ten individual EU countries, and their interaction with the austerity regime established at EU level which in fact is deepening the crisis rather than paving ways out of it. The most dangerous implication of this policy approach is, according to this study, that it is driving countries apart - misleadingly in the name of 'Europe', hence the title of the book 'divisive integration'. The main message of the book is that a gradual recovery is possible only if there is a change of course in individual countries that then triggers reactions in the policies of other countries and perturbations at the EU level. However, these changes in individual countries is no longer feasible without a green light or at least toleration from the level of the European institutions.

Since 1994, the EU has established mechanisms for information and consultation procedures for workers in transnational companies (European Works Councils Directive 94/45/EC). In 2009, the EWC Directive was reviewed and amended (Recast EWC Directive 2009/38/EC). The year 2016 will see the formal conclusion of a new evaluation procedure designed to ascertain whether the improvements of 2009 have had any impact on the EWC's conditions of operation and whether any further amendements should be considered. This book assesses in detail the ways in which key improvements brought about by the 2009 EWC Recast Directive have been implemented in national legislation. Our planetary limits demand a radical transition from the energy-intensive economic model based on the extraction of finite resources, which has been dominant since the first industrial revolution, to a model that is both sustainable and equitable. Unfortunately however, energy transformation in Europe has, after a promising start, fallen hostage to austerity and to the main philosophy underpinning the crisis management policies in which overall competitiveness is reduced to the much narrower concept of cost-competitiveness. Regulatory uncertainty, design failures built into incentive systems, and unjust distribution of the costs, have also contributed to the reversal of progress in energy transformation currently observable across Europe. In this book three country case studies highlight the different facets of these conflicts, while additional light is thrown on the situation by an account of the lack of progress in achieving energy efficiency. By way of conclusion, a mapping of the main conflicts and obstacles to progress will be of help in formulating policy recommendations. Ambitious climate and energy policy targets should be regarded not as a burden on the economy but rather as investment targets able to pave the way to higher employment and sustainable growth. It is high time for this perception to be recognised and implemented in the context of Europe’s new Investment Plan, thereby enabling clean energy investment to come to form its central pillar. A shift in this direction will require an overhaul of the regulatory and incentive systems to ensure that the need for just burden-sharing is adequately taken into account.
